Massachusetts requirements are as strict as OSHA. The original Mass General Laws are still in effect. 454 CMR 25.00 requires all public sector employers to comply with OSHA regulations. DLS will continue to conduct on-site safety and health inspections to evaluate workplace conditions and will make recommendations for the prevention of work-related injuries and illnesses. DLS may issue a “Written Warning” which contains an “Order to Correct” when an inspection reveals a condition which could cause a work-related injury or illness. DLS may issue a “Civil Citation” with a Civil Penalty when an employer fails to abate a “Written Warning”, or repeats conditions (violates regulations) identified in a previous “Written Warning”.
They will also conduct outreach to familiarize employers with their responsibilities under the OSHA regulations. And the DLS has a Voluntary Assistance program whereby the DLS offers technical assistance to public sector employers to help them comply with the regulations.
Under the Voluntary Assistance program, there will be no written warnings or penalties issued for voluntary compliance but the issues identified must be corrected within the time set by the DLS. MIIA has worked closely with the MA DLS for the past few years as the state has prepared to implement the amended and existing safety and health regulations that apply to our members.
